Recently, a US court ruled that jailbreaking is not against the law, and that it is legal to do so, provided you are doing it for your sole use and you are not benefiting financially from it.

Apple, the maker of the popular iPhone, the target of most jailbreakers, however reiterated their stand that while the courts have ruled jailbreaking is legal, they still discourage consumers from jailbreaking their devices because it will void product warranty.

And in a bid to prevent jailbreaking, Apple is pushing for a patent application that will effectively put them in control to those who commit the act.

In a recent filing to the patent office, Apple filed "Systems and Methods for Identifying Unauthorized Users of an Electronic Device". Primarily, what Apple wants to do with the application is to offer to brick the device once an unauthorized user is detected. But others see the filing simply as a way to control the users and prevent people from jailbreaking the device.

More than preventing jailbreaking, Apple wants to act as Big Brother.

Once an unauthorized user is detected, "access to particular applications can be restricted, access to sensitive information can be restricted, sensitive information can be erased from the electronic device..."

How can they detect "unauthorized user"? Apple can activate your phone camera or get your vital information and location. "The photograph, recording, or heartbeat can be compared, respectively, to a photograph, recording, or heartbeat of authorized users of the electronic device to determine whether they match. If they do not match, the current user can be detected as an unauthorized user."

Privacy advocates reacted on this part of the filing, and said that Apple is on its way to becoming way beyond Big Brother.
